This action was commenced on December 7, 1962, by the appellant James Latham to recover wages due on an oral contract of employment. The defendant Casey & King Corporation denied the allegations and pleaded a counterclaim to which a reply was interposed. Upon the appellants counsels failure to appear at a pretrial conference on March 11, 1963, the court sua sponte ordered judgment dismissing the complaint and granting the prayer of the defendants counterclaim. An application of the appellant to vacate the judgment under sec. 269.46 (1), Stats., on the ground of inadvertence and excusable neglect was denied. This appeal, however, is from the judgment dismissing the complaint and granting judgment on the counterclaim.
